Re: Refund Policy: as of 1 August 2023

All sales are final and no refund will be issued unless otherwise set forth within this refund policy. When you make a purchase on or receive a gift through the Montjoy App, LLC services, including in third-party extensions, you have immediate access to and use of, the Ancillary Products and Services you have purchased. Accordingly, except as detailed in the Terms of Sale, to the extent permitted by applicable law, cancellations are not permitted after a purchase, and we do not offer any refunds or credits, including, without limitation, fees for Subscription Services, unless otherwise outlined within this refund policy. Montjoy App, LLC reserves the right to modify this refund policy at any time.

Unless otherwise specified within or required under the applicable law in your jurisdiction, services, in-app items, and other digital goods are not returnable after purchase, included those purchased in third-party Extensions.

If you have problems with the download or installation of the Montjoy App or with use of items purchased in Extensions, please contact Customer Support.

Service Descriptions and Availability, Errors:

Montjoy App, LLC, its suppliers, and licensors continually upgrade and revise the Montjoy App, LLC Services to provide you with new Ancillary Products and Services.  Montjoy App, LLC may revise, discontinue, or modify Ancillary Products and Services at any time without prior notice to you, and Ancillary Products and Services may become unavailable without notice. Montjoy App, LLC shall have no liability of any kind if an Ancillary Product or Service that has been ordered is unavailable. If necessary, Montjoy App, LLC reserves the right to cancel an order or substitute an Ancillary Product or Service of equal or greater value when a product, service, or content is unavailable. For example, for pre-paid purchases, if services stop being available, Montjoy App, LLC has the option to provide you with a service credit, with a value equal to the amount charged to your payment method.

We attempt to be as accurate as possible and eliminate errors on the Montjoy App, LLC Services; however, we do not warrant that any Ancillary Products and Services or description, video/photograph pricing, or other information of a product, service, or content is accurate, complete, reliable, current, or error-free. In the event of an error, whether on the Montjoy App, LLC Services, in an order confirmation, in processing an order, delivering an Ancillary Product or Service, or otherwise, we reserve the right to correct such error and revise your order accordingly if necessary (including charging the correct price) or to cancel the order and refund any amount charged. In addition, we may, in lieu of a refund as provided in this paragraph, opt to provide you with a service credit, with a value equal to the amount charged to your payment method. Montjoy App, LLC reserves the right to determine and modify from time to time the exact nature of any such service credit, including conversion into one or more different types of Ancillary Products and Services credits. Your sole remedy in the event of an error is to cancel your order and obtain a refund or credit as set forth above.

No Refunds; Payment Upon Termination:

Unless otherwise agreed by the parties in a written amendment referencing this Agreement, the Fees paid or payable are non-refundable. Montjoy App, LLC will not refund any prepaid Fees to Client in connection with any termination or expiration of this Agreement, except for termination of the Agreement for Montjoy App, LLC’s agreement breach. In no event will termination relieve Client of Client’s obligation to pay any Fees owed to Montjoy App, LLC.

Marketplace Offerings:

All Marketplace Offerings are subject to availability, and we cannot guarantee that Marketplace Offerings will be available. Certain Marketplace Offerings may be available exclusively online through the Site. Such Marketplace Offerings may have limited quantities and are subject to return or exchange only according to our Return Policy.

Order Acceptance/Confirmation:

Montjoy App, LLC may, in its sole discretion, refuse or cancel any order and limit order quantity. Montjoy App, LLC may also require additional qualifying information prior to accepting or processing any order. Once we receive your Online or Call Center order, we’ll provide you with an email order confirmation. Your receipt of an order confirmation, however, does not signify Montjoy App, LLC’s acceptance of your order, nor does it constitute confirmation of our offer to sell; we are simply confirming that we received your order. Montjoy App, LLC reserves the right at any time after receiving your order to accept or decline your order for any reason. If Montjoy App, LLC cancels an order after you have already been billed, Montjoy App, LLC will refund the billed amount.

Product Availability and Limitations:

Given the popularity and/or supply constraints of some of our services, Montjoy App, LLC may have to limit the number of services available for purchase. Trust us, we’re building them as fast as we can. Montjoy App, LLC reserves the right to change quantities available for purchase at any time, even after you place an order. Furthermore, there may be occasions when Montjoy App, LLC confirms your order but subsequently learns that it cannot supply the ordered product. In the event we cannot supply a product you ordered, Montjoy App, LLC will cancel the order and refund your purchase price in full.

Payment:

You understand that use of the Services may result in charges to you for the services or goods you receive ("Charges"). Montjoy App, LLC will enable your payment of the applicable Charges for services or goods obtained through your use of the Services. Charges will include applicable taxes where required by law. Charges may include other applicable fees, product return fees, cancellation fees, and/or surcharges. Further, you acknowledge and agree that Charges applicable in certain geographical areas may increase substantially during times of high demand or due to other marketplace factors.

All Charges and payments will be enabled by Montjoy App, LLC using the preferred payment method designated in your Account, after which you will receive a receipt. If your primary Account payment method is determined to be expired, invalid or otherwise not able to be charged, you agree that Montjoy App, LLC may use a secondary payment method in your Account, if available. Charges paid by you are final and non-refundable unless otherwise determined by Montjoy App, LLC.

Montjoy App, LLC may charge you a fee if, during your use of the Services, you have caused damage in any manner. The amount of such fee shall be determined, in Montjoy App, LLC’s sole discretion, based on the type of damage and the severity. Montjoy App, LLC reserves the right to verify or otherwise require documentation of damages prior to processing a fee. In the event that a damages request is verified by Montjoy App, LLC in Montjoy App, LLC's reasonable discretion, Montjoy App, LLC reserves the right to facilitate payment for the reasonable cost of such damage using your payment method designated in your Account. Such amounts will be transferred by Montjoy App, LLC to a Third Party Provider, if applicable, and are non-refundable.

Additionally, if you fail to comply with these Terms you may be responsible for Charges, including without limitation, for transactions that could not be completed properly, arising out of or in connection with your failure to comply with these Terms.
